Is my UAS Operation Commercial in Nature?

Just because you aren’t getting paid for flying your UAS, doesn’t mean the FAA won’t consider you a commercial operator.  The FAA takes a narrow view of what operations fall under the recreational exemption, meaning that your operation could inadvertently fall under Part 107.  The FAA has an interactive tool to help you determine if your operation is commercial.  See https://www.faa.gov/uas/getting_started/user_identification_tool/ for more information.  For example if you are a real estate agent and you use your own drone to photograph your listings, it is considered a commercial use by the FAA.
